At the same time, CORD also accused the Nation Media Group (NMG) and Standard Group of swaying the public opinion against the CORD petition after they highlighted IEBC's response to CORD petition.

They said journalists from the two major media houses are swaying the public opinion by writing articles that favour Jubilee Alliance in the petition.

CORD alliance last week filed a petition at the Supreme Court challenging the declaration of Uhuru Kenyatta as the fourth President of Kenya by the IEBC on March 9th.

The ruling of the petition is expected not later than Friday next

ATTACKS ON SOCIAL MEDIA INSINCERE

The government seems to be moving towards blocking most social media outlets in this country, for fear of the use of these networking tools to force an uprising after word went out that the March 4th elections were not free and fair to its entirety.
Make no mistake; social media is a powerful weapon against tyranny. It works great to get a company to admit they are at fault or get a government to admit it is no longer worthy of serving its people. Whatever the point is, when there is a problem, and social media is available to help solve it, the problem usually gets solved. Unfortunately in Kenya the government believes they can stop social media and therefore resist efforts to help their people live better lives. Given what has happened recently in the Middle East, this seems highly unlikely.
Social media is believed to have played a major role in uprisings in North Africa, including the popular movements that forced out Egyptian President Hosni Mubarak and Ben Ali of Tunisia and is playing a major role in the Syria uprising where the President Assad’s government has managed to ban any media from accessing the atrocities in the year long civil war.
In Kenya, the story seems to be taking a different turn… There has been a systematic attack on the social media from the traditional media, the church and now the government. All who accuse the social media of spreading ethnic animosity and hate following the contested general elections.
One is struck at how traditional media and organization that use the media seem to be of the mind that “something has to be done,” even as they make efforts of their own to engage with their audiences through social media. It’s almost as though, having lost the means of controlling the message, they would now rather exert some control over social media itself. The multitude of bloggers, forum members and tweeters is too immense, too fragmented to corral, so the implicit threat of legal action is used. The speed at which information can be disseminated means that traditional journalism can find itself playing catch-up, so social media storms are dismissed as incoherent, messy, or simply well-meaning idiots succumbing to mob mentality.
This is a trend that must not be agreed to by any sane human being. I detest with all possible terms. First, because suing somebody who writes something you disagree with is, in most cases, using the proverbial sledgehammer to crack a nut. Second, because bloggers and readers who also use social media are probably better-informed than some traditional journalists think. Yes, it can seem overwhelming when an item is trending, but people do have the choice as to whether or not to retweet, share or re-blog. Aside from the spammers, nobody has an incentive to hitch their wagon to a topic. It is the ease with which views can be expressed that has changed, not the level of engagement.
I’m not trying to paint the social media white and say it’s all angelic. It is true that the social media in Kenya has been used for nearly all good intentions until the recent backlash in the elections that have seen many Kenyans vent their anger at the elections on social media with opposing sides pulling different directions. It’s true that the Post Election Violence, has gone “digital” with a host of “not so kind statements” that would probably not feel comfortable saying finding their way into the social media posted under pseudo names. But before we turn the attention to the bloodletting on social media, let us ask ourselves where the rain started ‘beating’ us.
In the run up to the 2007 General Elections and in the events that followed in 2007/2008 post election violence, the media was blamed for either being extremely partisan or simply being oblivious of fair and just reporting. An argument that will need another forum to fully exhaust… Fast track to 2013, the media this time round played “by standers” not wanting to be seen as the agents of war as was the case in 2007/2008. Various media houses, through the Media Owners Association and Media Council of Kenya, were forced to sign a Code of Ethics for reporting the election process. Journalists were given stern “warnings” on what to report and what is newsworthy and that is where the plot was lost.
When the tallying process of the presidential elections ran into trouble at the Bomas of Kenya, the media, keeping in touch with Code of Ethics, maintained a buffer zone and questioned no one. The proverbial “see no evil, say no evil” was put to play. Kenya’s saw the numerous discrepancies, but the media said nothing about them and that is where the social media offered a “discussion platform” for the majority. They went on facebook and twitter to share their experiences, their disgruntlement and their hope that all would be well.
All these, even when the traditional kept their composure and urged Kenyans to maintain peace, when there was no need for the call for peace… to resume work, when everyone was busy thinking of life after elections and to accept the results/outcomes of the elections a whooping 72 hours before official results were announced.
Whereas previously, public reaction to a particular newspaper article may have been gauged by the number of letters sent to the editor, today people can express their opinion wherever they like, and others can chime in to voice their agreement or disagreement, without having to set up a petition or letter-writing campaign.
Change can be unsettling, and as the media landscape changes, there are bound to be more debates and arguments about the role and responsibilities of traditional media, social networks, and how people and businesses use them. While I don’t think that the internet is a free utopia where nothing bad ever happens, neither do I see it as a lawless Wild West where chaos reigns. Social networking is largely being, provided you are willing to get involved. It’s those who are determined to keep a hands-off approach that is likely to face the biggest challenges.
In real sense, the fence seating by the traditional media, the church and to the greater extent the government is the main reason why social media is what it is today and attempts to gag it and paint it evil is just but another avenue for the three to run away from the reality of their failures yet again. So before the church, the government and the social media through the goblet the social media direction… Let them first remove the splint in their own eyes before noticing the log in the eyes of social media users.

This real it happened to me on Sunday. I went to town to buy a phone cover downtown. At the shops opposite Afya center or Ukwala and Tuskys, everywhere I went they kept asking me to show the phone despite the fact that I mentioned the make

I went to the final shop that was manned by a lady and she asked to see my phone and since she was a lady she gained my trust and gave her my phone. Just then she started moving out of the counter with my phone claiming she was going to ask at the back store.

Immediately my conscience refused and I asked her to give me my phone which she did. Just then a man rubbed my hand at the back and passed by showing me a phone, but since I don't buy street items I ignored.

After about one minute I became very tired in my mind and all I wanted was sit down, I all of a sudden felt very drowsy.

Just then the lady returned and with a case that didn't suit my phone, and she once again asked me to see my phone. Just when I was about to give her the phone, my son started crying saying he felt very tired and like vomiting, and immediately I held his hand and started walking away.

As we left with my son the lady told me to wipe off some white powder on the back of my hand exactly where the man had hit me. Luckily, we passed by my friends stall a few meters away and when we got there we both fell into deep sleep for about 10 min.

When I woke up and explained to my friend she gave us plenty of water to drink and said that's the new trick they are using to rob you. She claimed the white powder is used to make your mind dull and in a slow mood, she said it’s a drug given to schizophrenia guys to make them less active.

When you breathe it your mind becomes dull and you respond without thinking to the demands of the person controlling you. THIS SHE HAS NOT CONFIRMED BUT HAS JUST HEARD GUYS SAYING SO.

Guys be careful when you go to town, I have not confirmed the medical use of the whitish powder but all I know is I lost my active thinking

It may be digitalised generation but the script is a blast from the past.


A few days ago, Prof Ngugi wa Thiong’o wrote that the real winner in the recent presidential elections was Daniel arap Moi.


How right he was; but even he could not have guessed how soon Nyayo tendencies would re-emerge.


The Moist script is familiar; and for those of us who cut our teeth opposing dictatorship in the 1980s and 1990s, it is eerie. It starts with controlling messaging so that the dominant voice is one of suppression and censorship: The less people know, the better.


Our press fell into that trap a few weeks ago, suppressing any voice, image or fact that would expose the IEBC and the shambolic way it conducted the polls. So much so that it was praised for “being responsible,” in much the same way Moi regularly praised the Voice of Kenya and Kenya Times.


Then, unable to control the foreign press that was the only source of credible and accurate information, government operatives turned to threats.


This was a common tactic in the Moi years, when a number of foreign journalists were deported for critical reporting. Many were harassed and threatened openly.


Following this, we hear loud lamentations for peace and “moving on” despite the fact that the election process will only be concluded when the Supreme Court decides on cases before it.


This is reminiscent of Moi’s infamous slogan of “peace, love and unity” and his constant reminders that we should be grateful that we were not Somalia, Ethiopia or Sudan and Uganda even as repression, corruption, and impunity went on unhindered, benefiting a select few.


A major part of the Moi script was the obvious and pre-emptive presence of armed police, ready to pounce on people perceived to challenge his authority. It was one way of intimidating the populace.


The scenario has begun replicating itself. From the time election results were announced, armed police on lorries are everywhere, including Supreme Court premises. We are now not sure if these are the reforms Chief Justice Willy Mutunga would like to be associated with, especially given his well known mantra that these are “people’s courts.”

This show of force is intimidating, yet there are other subtle ways of ensuring security.


And then there is that well rehearsed song that anyone with a view that contradicts the dictator’s is “dancing to the tune of foreign masters.” The underlying message is that Kenyans can’t think for themselves and need the help of aliens.


If you don’t accept the leaders thinking for you, then it must be that it is foreigners thinking on your behalf. How insulting!


In the Moi days, it was JJ Kamotho, Oloo Aringo, Shariff Nassir, Kariuki Chotara, Ezekiel Barngetuny and their ilk parroting this song. It is now done over cyberspace but it is the same tune. It is more insidious now, with the use of titles like “evil society” that parallel the “inyenzi” or cockroaches that Hutu killers used to describe the Tutsi in Rwanda before embarking on a murderous spree.


And there is the familiar trooping to pledge loyalty to the King even before he is crowned, with all manner of smaller parties begging to be brought into governing fold so that they too can eat. This is touted as encouraging “unity” but as we discovered these past five years, lack of opposition only fosters corruption, sleaze and more decay.


The worst is the brazen violation of our Constitution and international human rights law with the supposed banning of public meetings and protests by functionaries and bureaucrats who claim to be impartial but act more like party hawks for the dominant group.


These statements should forewarn us about the sort of regime we should expect: repressive, non-accountable, disrespectful of the constitution and the law and one that will not brook criticism or independent thinking. It is moving forward to the well known Moist past.

What security CHIEFS, told RAILA...


Prime Minister Raila Odinga cancelled his countrywide ‘thank you’ rallies following advice from his lawyers and talks with spymaster Michael Gichangi and Inspector General of Police David Kimaiyo.


The lawyers told him the rallies were inappropriate given the warning on Wednesday by Chief Justice Willy Mutunga against public discussions of petitions filed in the Supreme Court challenging Mr Uhuru Kenyatta’s win.  


Prime Minister also met Mr Gichangi and Mr Kimaiyo who asked him to call off the rallies on security grounds. He was reportedly told his rallies could fan emotions among his supporters, a fact that could undermine peace.


The PM met the security chiefs in his office at BP Shell Building on Wednesday afternoon.  This was after his legal team had briefed him on the directive by Dr Mutunga, who is also the President of Supreme Court.


The legal team advised Raila to call off the rallies, arguing there was no way he was going to address his supporters without touching on his two petitions and the outcome of the March 4 presidential election, which he is on record dismissing as electoral fraud against him. Raila was the Coalition for Reforms and Democracy (CORD) presidential candidate.


Kimaiyo confirmed they reached out to the PM saying: “We were trying to reach the CORD leaders directly and diplomatically to implore them to drop the planned rallies for a while.”


TRIGGER VIOLENCE

After meeting the PM, Gichangi and Kimaiyo attended the country’s top security organ — National Security Advisory Committee (NSAC) meeting. NSAC sitting that late in the evening urged Raila and his running mate in March 4 race, Vice-President Kalonzo Musyoka, to suspend their rallies saying they could trigger violence.


The committee, which is chaired by Head of Civil Service, Francis Kimemia, also declared it would not allow the meetings to continue as planned. Other Members of the committee are Permanent Secretaries Mutea Iringo (Internal security), Thuita Mwangi (Foreign), Nancy Kirui (Defence), and Attorney General Githu Muigai. Apart from Gichangi, and Kimaiyo, the two Deputy Inspector Generals of Police – Grace Kaindi and Samuel Arachi – also sit in it.
NSAC urged Raila to let the judges of the Supreme Court to arbitrate on the petition protesting the results of the presidential election.


 “The court process should be left to the judges. Any attempts to disrupt, discredit or intimidate the courts, IEBC or other institutions of the State would not be tolerated,” the National Security Council warned. 


CORD lawyers, who included former Attorney General Amos Wako and Senior counsel Mutula Kilonzo and James Orengo, advised Raila and Kalonzo to call off the rallies.


On Thursday, Mutula confirmed to The Standard they advised the PM to heed the CJ’s directive. “My colleagues Amos Wako, James Orengo and I advised the PM on the need to comply with the court directive because there is no way we can meet a crowd and fail to talk about the matter,” he said.


The Makueni Senator-elect assured CORD supporters there was no cause for alarm because even the period for the hearing of the petition was short and hearing would conclude fast. 

“There is no reason to worry because we shall be back,” was Mutula’s parting shot.


On Wednesday Mutunga said the Supreme Court had taken charge of the petitions and the merits or demerits of the suit could only be canvassed in court. He directed lawyers to advise their clients on the dangers of discussing the case outside the courtroom.


Prior to the CJ’s directive, the PM had maintained a hardline stand, saying he would not stop speaking about the petition. But he said he would avoid talking about the contents of the case.
“Prime Minister Raila Odinga has not planned any rallies in any part of the country in the coming days, including this weekend. The idea of such rallies had been discussed, but was dropped on Thursday after consultations,” Raila’s spokesman Dennis Onyango later said in a statement.


UNDO GAINS


Mr Onyango explained Raila and CORD leadership agreed to suspend all political activity for the duration of the hearing of the petitions.


Raila, Kalonzo, and Bungoma Senator-elect Moses Wetangula had planned to be in Kakamega tomorrow before heading to Kisumu and Nakuru on Sunday.


Kimemia said the directive affected all other political parties that plan similar rallies. He said the parties’ code of conduct signed with IEBC still stands. He later explained the Wednesday security meeting was convened to deliberate on Raila’s recent claims he had won the presidential election.



Mr Kimemia said the meeting upheld a directive by Kimaiyo that banned mass action, demonstrations, and political gatherings.


 “Such meetings could undo gains made from the peaceful conduct of elections, which demonstrated to the world that Kenya’s democracy had matured and investors were already releasing investment capital,” said Kimemia.


The committee also directed police to disperse crowds that usually gather near Supreme Court terming them illegal.


But the move can be legally challenged because the Constitution allows freedom of speech and assembly. Such freedom should, however, be enjoyed in a way that does not affect another party.

It seems the competition for Big Brother positions is steaming hot. Literally!

Big Brother auditions started recently, and they are now in the final stages of shortlisting contestants to participate.

 

Vera was among the shortlisted competitors, and boy did she make her case solidly! Now this girl is well known for her overtly sexual persona, which has been demonstrated in the past by the fact that she has named her booty.This makes her a prime target for Big Brother audiences, who eagerly anticipate things like seeing the female contestants naked during the Shower Hour.

 


According to eye witnesses at the auditions, Vera was dressed in a dress when she went in front of the judges. Shortly into the interview, she proceeded to bend over and remove her undergarments in full view of the judges, and the contestants who were waiting to go after her. Needless to say, the judges were very impressed by what they saw, and cheered Vera on every step of the way!

 


When I asked Vera why she did it, she said, "I was simply feeling hot, and so I decided to remove my panties. I mean, why should I have gone all the way to the toilet to remove them? I just decided to do it there,

 

I don't see anything wrong with that. I got a really good reception from the judges. They were really having a lot of fun during my whole audition."

  Over the week, news on a new sex comedy show coming out in a month’s time took the media by storm. Well the most interesting news is that Tusker Project Fame Judge Ian Mbugua will be starring in the film which will feature weird sexual habits of Kenyans.
The shooting of the film has already started and a Facebook page is out. The film is directed by Lizz Njagah’s husband Alex Konstantaras and in their page they say:
"HOUSE of Lungula is a Sexy Comedy movie coming soon touching on the sexual habits of Kenyans. Paris - The International Criminal Court will not drop the crimes against humanity charges against Kenyan president-elect Uhuru Kenyatta, The Hague-based court's chief prosecutor said on Wednesday.

"We will not drop the charges," Fatou Bensouda told reporters in Paris, saying it was only a question of when, not if, he goes to trial.

Kenyatta, 51, stands accused of orchestrating deadly violence that followed disputed polls five years ago. He was named Kenya's new president in a closely-fought election this month, though his main rival has filed a legal challenge against the win.

Bensouda said she deplored the lack of co-operation from the Kenyan government in the ICC cases related to the east African country, which she said suffered from witness intimidation.

"Kenya is the most challenging situation our office has had to deal with," she said.

Lawyers for Kenyatta on Monday urged the ICC to dismiss the case against him after prosecutors last week dramatically dropped all charges against Kenyatta's co-accused after a key witness withdrew testimony.

It was the first time ICC prosecutors decided to drop a case since the world's first permanent independent war crimes court began operating in 2002.

Should the charges against Kenyatta stand, he will become the first-ever president to have to fly off to The Hague to face a trial that could last at least two years shortly after taking office.

Kenyatta, one of Africa's richest and most powerful men, was declared the president just over a week ago following the first elections after the African country's post-poll unrest five years ago in which ICC prosecutors say some 1 100 people were killed.

Criminal gang

Prosecutors suspect Kenyatta of having paid the Mungiki, a sect-like criminal gang notorious for beheading its victims, to lead reprisal attacks and defend the Kikuyu community when violence ripped through the country.

Kenyatta denies the allegations.

His trial is scheduled to begin in July and he has repeatedly vowed to co-operate with the legal proceedings.

The evidence against Kenyatta's co-accused, top civil servant Francis Muthaura, was critically undermined when a key prosecution witness, known as "OTP-4", recanted earlier testimony.

Lawyer Steven Kay on Monday said the five charges against Kenyatta, including rape and murder, should now also be reconsidered.

Because of the withdrawal of that witness "this matter has to go back for reconfirmation by the pre-trial chamber", Kay told the court, saying this witness' statement "is the backbone of the prosecution's case from the beginning to end".

"To a certain extent we have lost faith in the decision-making as we warned the pre-trial chamber of the quality of the evidence and we were ignored," Kay said.

More than 663 000 people were displaced in Kenya's Rift Valley five years ago after fights between rival supporters, prosecutors said, when politically motivated riots soon turned into ethnic killings, which in turn sparked further reprisals.


The clashes destroyed Kenya's image as a beacon of stability in the region, hurt its tourism industry and exposed long-simmering ethnic rifts among its population.
